These Terms of Use ("Terms") govern your access to and use of GokuGoku, including the GokuGoku mobile application, website, backend services, AI-assisted Japanese learning features, notifications, subscriptions, and related services (together, the "Service").

By creating an account, using the Service, starting a trial, or purchasing a subscription, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who We Are

"GokuGoku", "we", "us", and "our" mean the GokuGoku service operated by Sandro Maglione, ditta individuale, Partita IVA 03994990137, with registered/business address at Corso Unità d'Italia 10, Cantù, Italy.

2. Eligibility

The Service is not intended for children under 16. By using the Service, you confirm that you are at least 16 years old, have the legal capacity to accept these Terms, and are allowed to use the Service under applicable law.

If you use the Service on behalf of another person or organization, you confirm that you have authority to bind them to these Terms.

3. Account and Security

You need an account to use most Service features. Authentication may be provided through Clerk and supported sign-in providers such as Google.

You are responsible for keeping your account access secure and for all activity under your account unless caused by our own misconduct. You must provide accurate account information where required and must not share, sell, or transfer your account.

4. The Service

GokuGoku is self-serve software for personal Japanese language learning. It may provide AI-generated practice prompts, dialogue practice, example sentences, sentence review, corrections, explanations, grammar-pattern feedback, saved study items, history, progress, reminders, and related learning features.

The Service is not live tutoring, human coaching, a human expert community, an official translation service, an exam or certification service, or a service for completing school, employment, immigration, legal, medical, financial, or other regulated tasks.

5. Trials, Subscriptions, Billing, and Refunds

Some features require an active trial or paid subscription. Subscriptions are sold through Apple App Store In-App Purchase on iOS and Google Play Billing on Android. Available plans may include monthly and yearly auto-renewing subscriptions.

Prices, taxes, trial availability, renewal timing, cancellation options, refund handling, and payment methods are shown and managed by Apple or Google before purchase and in your Apple Account or Google Play account settings.

5.1 Trial access

GokuGoku may offer trial access. Trial duration and eligibility may vary and may be limited to new or otherwise eligible accounts. We may deny, revoke, or limit trial access if we reasonably detect duplicate use, abuse, fraud, or manipulation.

If a trial is attached to an Apple or Google subscription offer, the trial renews into a paid subscription unless you cancel through the relevant store before the trial ends.

5.2 Auto-renewing subscriptions

Subscriptions renew automatically unless canceled through Apple or Google before the renewal deadline shown by the relevant store. Your store account may be charged for renewal before the end of the current period according to Apple App Store or Google Play rules.

An active subscription gives you access to the paid features available for your plan during the subscription period, subject to these Terms, technical availability, fair-use limits, and store entitlement verification.

5.3 Cancellation

You can cancel your subscription through your Apple App Store or Google Play subscription settings. Deleting the app or deleting your GokuGoku account does not necessarily cancel your Apple or Google subscription. You must cancel the subscription through the store if you want to stop future charges.

After cancellation, your paid access generally continues until the end of the current paid billing period unless Apple, Google, applicable law, a refund, or a store status change provides otherwise.

5.4 Refunds

Refunds for in-app purchases are handled by Apple or Google under their own policies and applicable law. We cannot guarantee refund approval.

For Apple purchases, request a refund through Apple. For Google Play purchases, request a refund through Google Play or contact us if Google directs you to the developer for support.

Nothing in these Terms limits any non-waivable consumer, withdrawal, refund, conformity, or cancellation rights you may have under applicable law.

5.5 Store terms

Your purchase is also subject to the Apple Media Services Terms and Conditions or the Google Play Terms of Service, as applicable. If store terms conflict with these Terms for billing, cancellation, renewal, or refunds, the store terms and mandatory law control for that purchase flow.

6. Usage Limits and Availability

AI features are subject to technical, safety, and fair-use limits. Current authenticated account limits are:

  • prompt generation: 100 requests per day and 2,400 requests per month
  • sentence review: 80 requests per day and 2,000 requests per month

Limits may reset daily or monthly, may be enforced automatically, and may change if needed to protect reliability, prevent abuse, manage provider limits, comply with law or store rules, or adjust the Service. We may also temporarily throttle, suspend, or block requests that appear abusive, automated, unsafe, fraudulent, or technically harmful.

The Service may be interrupted, delayed, unavailable, or degraded because of maintenance, updates, infrastructure issues, AI-provider issues, store entitlement delays, network failures, or events outside our control.

7. AI Features and AI Limitations

GokuGoku uses AI systems to generate and review language-learning content. AI output can be inaccurate, incomplete, inconsistent, delayed, offensive, unsafe, or unsuitable for your intended use.

You acknowledge that:

  • AI output is generated automatically and is not reviewed by a human before display
  • AI output may change between requests and over time
  • GokuGoku does not guarantee that prompts, corrections, explanations, scores, translations, grammar feedback, or examples are accurate
  • the Service does not guarantee any learning outcome, fluency result, exam result, certification, employment result, or professional outcome
  • you are responsible for reviewing AI output before relying on it

Do not rely on the Service for official translation, legal, immigration, medical, health, financial, safety-critical, professional, academic-assessment, employment, or regulated decisions.

If AI content appears unsafe, offensive, unlawful, infringing, deceptive, or wrong, use the in-app report feature where available or contact us at [email protected].

8. User Content

"User Content" means content you submit, save, or create through the Service, including practice sentences, prompt responses, custom saved items, profile preferences, study settings, reports, support messages, and related learning content.

You keep ownership of your User Content. You grant GokuGoku a limited, non-exclusive, worldwide license to host, store, process, reproduce, display, transmit, and use User Content only as needed to operate, secure, support, improve, and provide the Service, including generating AI output, storing learning history, syncing subscription access, debugging issues, preventing abuse, and complying with law.

This license ends when your User Content is deleted from the Service, except where retention is reasonably needed for backups, security, fraud prevention, billing, dispute handling, legal compliance, or legitimate business records.

You confirm that you have the rights needed to submit your User Content and that it does not violate law, third-party rights, or these Terms.

9. Prohibited Conduct

You must not use the Service to:

  • violate any law or regulation
  • submit, request, generate, save, or distribute unlawful, infringing, exploitative, abusive, hateful, harassing, sexual, violent, deceptive, or otherwise harmful content
  • exploit, harm, or attempt to harm children
  • impersonate another person or use another person's name, voice, likeness, identity, or personal data without lawful authority and consent
  • generate deceptive content, scams, misinformation, fraudulent content, or content intended to mislead others
  • complete homework, exams, certification tasks, essays, job assessments, or other assessed work dishonestly
  • use outputs for official translation or regulated professional purposes
  • reverse engineer, decompile, scrape, crawl, benchmark, extract, copy, or analyze the Service to build competing products, datasets, models, or services
  • train, fine-tune, evaluate, or improve AI models or competing systems using Service content or outputs
  • overload, disrupt, probe, attack, bypass, or interfere with the Service, its security, or its providers
  • access the Service through bots, automation, shared accounts, unauthorized clients, or credential abuse
  • resell, sublicense, republish, or commercially exploit the Service or outputs except with our written permission

This list is not exhaustive. We may treat other conduct as prohibited if it threatens users, providers, the Service, our rights, or legal compliance.

10. Intellectual Property and Output Use

The Service, including software, design, interfaces, branding, databases, curated learning materials, and other GokuGoku content, is owned by us or our licensors and is protected by intellectual property and other laws.

Subject to these Terms, you may use AI-generated outputs and learning materials provided to your account for your personal learning purposes. You may not resell, publish at scale, package as a dataset, use to train or evaluate models, or use to build a competing service.

All rights not expressly granted are reserved.

11. Third-Party Services

The Service depends on third-party services, which may include Apple, Google, Clerk, Cloudflare, Sentry, Google Cloud, Gemini, Expo services, and other providers. Third-party services may have their own terms, privacy policies, availability limits, and account requirements.

We are not responsible for third-party services except where mandatory law provides otherwise.

12. Privacy

Our Privacy Policy explains how we collect, use, share, retain, and delete personal data. The Service includes in-app links to the Privacy Policy and these Terms.

13. Account Deletion

You can initiate account deletion in the app settings or contact [email protected]. Account deletion is intended to delete or de-identify GokuGoku-controlled account data and associated learning data, subject to verification, backups, security, billing, fraud prevention, dispute handling, and legal retention requirements.

Account deletion does not automatically cancel an active Apple or Google subscription. You must cancel subscriptions through Apple or Google to stop future charges.

14. Suspension and Termination

We may suspend, restrict, or terminate access to the Service, with or without notice where reasonably necessary, if you violate these Terms, fail to maintain valid subscription access where required, create legal or provider risk, threaten security or reliability, misuse AI features, abuse trials or usage limits, or engage in fraudulent or unlawful conduct.

You may stop using the Service at any time and may request account deletion as described above.

Sections that by their nature should survive termination will survive, including payment obligations already incurred, intellectual property protections, privacy-related rights, disclaimers, liability limits, and dispute provisions.

15. Changes to the Service

We may update, modify, suspend, limit, or discontinue all or part of the Service at any time. We may also change features, AI models, limits, pricing availability, subscriptions, and supported platforms.

Where required, subscription price changes, renewal changes, or consent requirements will be handled through Apple, Google, or applicable law.

16. Disclaimers

To the maximum extent permitted by law, the Service and all outputs are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory.

We do not warrant that the Service will be uninterrupted, secure, error-free, accurate, complete, suitable for your purpose, or that AI output will meet your expectations.

Nothing in these Terms excludes warranties or rights that cannot be excluded under applicable law.

17. Limitation of Liability

To the maximum extent permitted by law, GokuGoku will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, goodwill, data, learning progress, business opportunity, or expected results.

To the maximum extent permitted by law, GokuGoku's total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of:

  • the amount you paid for the Service during the 12 months before the event giving rise to the claim
  • EUR 100 if you have not paid for the Service

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms and may provide additional notice where reasonably possible or legally required.

Your continued use of the Service after updated Terms become effective means you accept the updated Terms.

19. Governing Law and Disputes

These Terms are governed by the laws of Italy, excluding conflict-of-law rules, except to the extent mandatory consumer protection law in your country of residence applies.

If you are a consumer, nothing in these Terms limits any mandatory rights or forum protections available to you under applicable law.

If you are not acting as a consumer, disputes arising out of or relating to these Terms or the Service may be brought before the competent courts in Italy.
