Terms of Use

These Terms of Use ("Terms") govern your access to and use of GokuGoku's website, learning platform, and related services, including learn.gokugoku.app (together, the "Services").

By accessing or using the Services, starting a free trial, or subscribing to a paid plan, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Services.

1. Who We Are

For the purposes of these Terms, "GokuGoku", "we", "us", and "our" refers to the GokuGoku service operated by Anna Baffa Volpe and Sandro Maglione.

2. Eligibility

The Services are not intended for children under 16.

By using the Services, you represent that:

  • you are at least 16 years old
  • you have the legal capacity to accept these Terms
  • you are not prohibited from using the Services under applicable law

3. Accounts and Access

Authentication and account access may be provided through third-party authentication services such as Clerk.

You are responsible for:

  • providing and maintaining accurate account information where required
  • keeping your login credentials and account access secure
  • all activity that occurs through your account unless caused by our own misconduct

We may rely on account identifiers supplied by our authentication provider to deliver the Services.

4. Free Trial, Subscriptions, Billing, and Refunds

Some paid features of the Services are offered on a subscription basis and billed through third-party payment providers such as Paddle.

4.1 Seven-day free trial

GokuGoku may offer a 7-day free trial for first-time eligible accounts.

Unless canceled before the trial ends, the trial automatically converts into a paid subscription using the billing method accepted through the checkout flow.

The free trial is limited to new or otherwise eligible accounts and may be limited, denied, or revoked where we reasonably detect abuse, duplicate use, manipulation, or other misuse.

4.2 Auto-renewing subscriptions

Unless otherwise stated at checkout, paid subscriptions renew automatically until canceled.

By purchasing a subscription, you authorize recurring charges through the selected payment method under the terms presented at checkout.

4.3 Cancellation

You may cancel your subscription at any time.

Unless mandatory law provides otherwise, cancellation stops future renewals and results in an immediate downgrade of paid access.

4.4 Refund Policy

The following refund policy applies to subscriptions purchased through the Services unless mandatory law provides otherwise.

4.4.1 Initial paid charge

You may request a refund of your initial paid subscription charge within 7 days of that first paid charge by contacting [email protected].

If approved, the refund applies only to that initial paid charge.

4.4.2 Renewal charges

Automatic renewal charges are normally non-refundable.

4.4.3 Free trial conversion

If you start a free trial, you are responsible for canceling before the trial ends if you do not want to be charged.

If the free trial converts into a paid subscription because you did not cancel in time, that charge is normally not refundable solely on the basis that you forgot to cancel before the trial ended.

4.4.4 When paid access starts

Paid access starts immediately when you purchase a subscription or when a free trial converts into a paid subscription.

Nothing in these Terms limits any non-waivable refund, withdrawal, or consumer protection rights you may have under applicable law.

5. Permitted Use

The Services are provided for personal, educational use to support Japanese language learning.

You agree not to:

  • violate any applicable law or regulation
  • harass, threaten, defame, exploit, or harm others
  • submit unlawful, infringing, malicious, deceptive, or abusive content
  • interfere with, disrupt, probe, overload, or degrade the Services
  • access the Services in an automated or unauthorized way, including scraping or bot access
  • share accounts or abuse credentials
  • reverse engineer, decompile, extract, copy, benchmark, or otherwise analyze the Services to build competing products, datasets, or models
  • collect or republish prompts, outputs, or other service content at scale
  • use the Services for unauthorized commercial exploitation

This list is not exhaustive. We may determine that other conduct is abusive or prohibited where it threatens the Services, users, providers, or our rights.

6. AI Features and Service Limitations

The Services may use AI systems to generate feedback, corrections, explanations, scoring, and audio or text outputs.

You acknowledge that:

  • AI-generated content may be inaccurate, incomplete, delayed, or unsuitable for your intended use
  • outputs may vary between requests and over time
  • the Services are a learning aid only and do not guarantee any specific educational outcome
  • you are responsible for evaluating AI-generated outputs before relying on them

To the maximum extent permitted by law, AI outputs are provided "as is".

7. User Content

You retain ownership of the content you submit to the Services, such as learning prompts, written exercises, and similar materials ("User Content").

You grant GokuGoku a limited, non-exclusive, worldwide license to host, store, process, reproduce, display, and use User Content solely as needed to:

  • operate the Services
  • provide account history and learning features
  • generate feedback and outputs requested by you
  • maintain, secure, debug, and support the Services

This license ends when your User Content is deleted from the Services, except to the extent retention is reasonably necessary for backups, security, fraud prevention, dispute resolution, or legal compliance.

You represent that you have the rights needed to submit your User Content and that doing so does not violate law or third-party rights.

8. Intellectual Property and Output Use

The Services, including the software, design, branding, interface, databases, and all content made available by GokuGoku or its licensors, are protected by intellectual property and other applicable laws.

Except where prohibited by law or expressly allowed by us, you may not copy, modify, distribute, sell, license, republish, or create derivative works from the Services or service content.

Subject to these Terms, GokuGoku grants you a limited, revocable, non-transferable right to use AI-generated outputs and other materials provided through the Services for your personal learning use only.

You may not use outputs or service materials to:

  • resell or republish them as a product or content library
  • build, train, evaluate, or improve competing tools, datasets, or services
  • reproduce them at scale outside the normal intended use of the Services

All rights not expressly granted are reserved.

9. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we process personal data and use service providers such as Clerk, Paddle, PostHog, Google Cloud, and Gemini.

10. Suspension and Termination

We may suspend, restrict, or terminate access to the Services, with or without notice where reasonably necessary, if:

  • you violate these Terms
  • you fail to pay applicable fees
  • we suspect fraud, abuse, security threats, or unlawful conduct
  • continued access creates legal, technical, or provider-related risk for us or others

You may stop using the Services at any time and may request deletion of GokuGoku-controlled account data as described in the Privacy Policy.

Where authentication, billing, analytics, infrastructure, or other functionality is provided through third-party providers, suspension, termination, or deletion of your GokuGoku service access does not necessarily mean the separate provider account, provider-held records, or provider-side data is automatically deleted unless we expressly confirm that as part of the deletion process.

Termination or suspension does not affect rights or obligations that by their nature should survive, including payment obligations already incurred, intellectual property protections, disclaimers, liability limits, and dispute provisions.

11. Changes to the Services

We may modify, update, suspend, or discontinue all or part of the Services at any time.

We are not liable for service changes, interruptions, delays, or unavailability except where mandatory law provides otherwise.

12. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory.

We do not warrant that:

  • the Services will be uninterrupted, secure, or error-free
  • the Services or outputs will always be accurate, complete, or fit for a particular purpose
  • defects will always be corrected

Nothing in these Terms excludes warranties that cannot be excluded under applicable law.

13. Limitation of Liability

To the maximum extent permitted by law, GokuGoku and its operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, goodwill, data, or business opportunity, arising out of or related to the Services.

To the maximum extent permitted by law, GokuGoku's total aggregate liability for any claim arising out of or relating to the Services will not exceed the greater of:

  • the amount you paid to GokuGoku for the Services during the 12 months before the event giving rise to the claim, or
  • EUR 100 if you have not made any payment

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

14. Feedback and Suggestions

If you submit feedback, ideas, suggestions, or recommendations about the Services, you agree that we may use them without restriction, attribution, compensation, or obligation to you.

15. Governing Law and Disputes

These Terms are governed by the laws of Italy, excluding conflict-of-law rules, except to the extent mandatory consumer protection law in your country of residence applies.

If you are acting as a consumer, nothing in these Terms limits any mandatory rights or forum protections available to you under applicable law.

If you are not acting as a consumer, any dispute arising out of or relating to these Terms or the Services may be brought before the competent courts in Italy.

16. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we will post the updated Terms and may provide additional notice where reasonably possible. Your continued use of the Services after the updated Terms become effective means you accept the revised Terms.
